• Provided litigation advisory, investigation and expert witness services relative to punitive damages phase of multi-million dollar real estate development breach of fiduciary duty litigation. Engagement required detailed analysis of the defendants' business and personal records, preparation of schedules of assets, liabilities, income and net worth for trial testimony, consultation with counsel relative to disputed discovery requests and opposing expert's deposition, and expert witness testimony at trial.
• Engaged to provide litigation advisory services relative to a breach of contract lawsuit involving the manufacture of Styrofoam containers for national distribution to restaurants. Provided lost profits calculations, analyzed opposing expert's report and assisted in opposing expert witness deposition.
• Advised major advertising agency on restructuring time-keeping practices, accounting, and billing systems. Quantified damages incurred by the government due to company's billing errors. Prepared attorneys for discussions with defense contract audit agency, Navy, Department of Justice, and SEC. Trained client's employees to implement internal financial procedures in compliance with government regulations.
• Business valuation and damage analysis allegedly suffered by a transportation company resulting from the cancellation of a multi-year transportation contract by a Fortune 100 pharmaceutical company. Engagement entailed calculation of valuation of the business immediately prior to the contract cancellation and the valuation of the business after the contract cancellation in the determination of the diminution of value to the enterprise and the related damages. Engagement entailed analysis of contracts, financial statements, issuance of valuation opinions and deposition and trial testimony.
• Valuation analysis of damages allegedly caused by a wireless carrier as a result of their alleged unfair pricing interference with a retail cellular reseller. Alleged damages exceeded $1 billion and involved analyses of multiple wireless companies during the damage period. Analysis included review of business valuation and economic damages calculated, financial statements of wireless companies, financial statements of reseller and numerous studies performed by marketing and economic experts.
• Valuation of multiple construction, real estate development, excavation and related entities in connection with a shareholder dispute. Engagement consisted of valuing each entity and advising the client of the tax consequences associated with the division of the entities among the shareholders and advisory services in connection with the ultimate structuring of the division of the related properties on a tax efficient basis.
